Homebuyers get a strong & much needed judgement in their favor from Delhi High Court

Delhi high court judge, Justice Rekha Palli, through her judgment has given a huge interim relief to homebuyers of Delhi who were in a difficult situation owing to payment of subsequent EMIs to Housing Finance Companies (HFCs) for incomplete projects. The judgement restrains the HFCs to take any coercive actions against them. The interim relief was the need of the hour, as developers were supposed to pay the EMI till possession who stopped it midway, and the homebuyers were at no fault in the entire process of investing in the projects and ideally should not pay EMIs under the scheme till possession.
This judgement is a clear indication that the regulator and judiciary are working in tandem to let the real estate market, especially the housing sector, run in a healthy and fair environment and the transaction process till possession shall continue as agreed upon at the time of closing the deal. Consumer is king is the summary of this judgement.
